PrimiLab Terms of Service

Welcome to the products and services provided by PrimiLab (the "Service" or "PrimiLab"). These Terms are entered into between you and the PrimiLab Team ("we" or "us") to set out the rights and obligations governing your use of the Service.
Before using the Service, please read these Terms carefully, in particular any clauses in bold or otherwise highlighted concerning the exclusion or limitation of liability, dispute resolution and jurisdiction. If you do not agree to any part of these Terms, please do not register for or use the Service. Once you complete account registration or use the Service in any way, you are deemed to have fully understood and agreed to these Terms.
1. The Service
PrimiLab is dedicated to redefining how content is created and shared with AI, and through its products (including but not limited to the "Micca" app) provides users with functions including but not limited to:
- •Capturing, uploading and editing images and turning them into "sticker" content;
- •Creating, joining and co-building "collections" to save and share stickers together with friends;
- •Recording additional information such as the capture location and place name for a sticker;
- •Social features such as adding friends, following other users and viewing updates;
- •Other functions or services we may add later based on our product plans.
The specific functions of the Service may change due to factors such as version, region, device and legal requirements. We may adjust, add or discontinue functions as appropriate and will notify you by reasonable means such as in-app notifications and announcements on our website.
2. Account Registration and Management
- •You must register using true, accurate and lawful information, and keep your account, password, verification codes and other credentials safe;
- •You may not transfer, lend, rent out or otherwise provide your account to any third party;
- •You are responsible for all activities that occur under your account; losses arising from unauthorized use of your account are in principle borne by you, except where caused by our fault;
- •If you discover unauthorized use of your account or any other security issue, please contact us immediately via the "Contact" section of these Terms;
- •To comply with applicable laws and regulations and the needs of service management, we may ask you to provide further identity-verification information.
3. User Content and Licensing
The intellectual property rights in the images, text, locations, collections and other content you upload, publish or transmit through the Service (collectively, "User Content") belong to you or the lawful rights holder. We respect your lawful rights.
For the purpose of providing, operating and improving the Service, you irrevocably grant us a worldwide, royalty-free, non-exclusive and sublicensable right to, within a reasonable scope, store, reproduce, modify (such as compress, transcode and generate thumbnails), transmit, display and distribute your User Content to recipients you select.
You are responsible for the content you upload and publish, and you warrant that:
- •You hold the lawful rights and authorizations necessary to upload the content;
- •The uploaded content does not infringe any third party's copyright, portrait rights, privacy, reputation, trade secrets or other lawful rights and interests;
- •The uploaded content does not violate laws, regulations or public order and good morals, and does not contain any content prohibited under Section 4 of these Terms.
4. Code of Conduct
When using the Service, you undertake not to engage in any of the following acts, nor to upload, publish or disseminate any information containing the following content:
- •Content that opposes the fundamental principles established by the Constitution or endangers national security, honor or interests;
- •Content that incites ethnic hatred or discrimination or undermines ethnic unity;
- •Content that promotes terrorism, extremism, cults, obscenity or pornography, violence or gore, or other illegal or harmful content;
- •Content that insults, defames, harasses, stalks or threatens others, or infringes others' lawful rights and interests;
- •Content that infringes others' copyright, trademark rights, portrait rights, privacy, personal information, etc.;
- •Spreading false information, malicious marketing or spam, or engaging in illegal activities such as gambling, pyramid schemes or money laundering;
- •Using crawlers, plug-ins, automated scripts or other technical means to access, copy or scrape the Service's data without authorization;
- •Interfering with or damaging the normal operation of the Service, or attempting to bypass our security and billing mechanisms;
- •Any other act that violates laws, regulations, public order and good morals, or these Terms.
If your conduct violates the foregoing, we may, depending on the severity, take measures such as removing content, restricting functions, suspending or terminating your account, preserving evidence and reporting to competent authorities. Any losses thereby caused to you are borne by you.
5. Intellectual Property
The intellectual property rights in the Service and all materials it contains — including but not limited to software, code, text, images, icons, interface design, logos, trademarks and trade dress — belong to us or the relevant rights holders and are protected by applicable law.
Without our prior written consent, you may not copy, modify, adapt, translate, reverse engineer, decompile or disassemble the Service, or use it for any commercial purpose.
6. Third-Party Services
The Service may integrate or link to services provided by third parties (including but not limited to map services, object storage, login authentication and payment). Such third-party services are provided independently by the respective third parties, and your relationship with them is governed by their own terms and privacy policies. We do not guarantee the availability, stability or legality of third-party services, but we will exercise reasonable care in selecting our partners.
7. Fees and Value-Added Services
Currently most functions of the Service are provided free of charge, while some may be offered on a paid or membership basis. The specific paid items, prices and rules are subject to the actual pages displayed in the app. All payments require your active confirmation; except as otherwise provided by law, fees already paid are non-refundable.
8. Changes, Suspension and Termination
- •We may upgrade, adjust, suspend or terminate some or all functions of the Service as required by business development;
- •In the event of system maintenance, network failures, force majeure and the like, the Service may be temporarily unavailable; we ask for your understanding of any inconvenience caused;
- •If you violate these Terms or applicable laws and regulations, we may immediately suspend or terminate the Service to you and reserve the right to pursue liability in accordance with the law;
- •You may cancel your account at any time via the means provided in settings; after cancellation, we will process or delete your related information in accordance with applicable laws and our Privacy Policy.
9. Disclaimer
To the maximum extent permitted by law:
- •The Service is provided on an "as is" and "as available" basis, and we make no express or implied warranty that it is entirely error-free, uninterrupted or absolutely secure;
- •We are not liable for losses caused by force majeure, third-party causes or your own causes (such as device failure or improper operation);
- •User Content is uploaded by users; its authenticity and legality are the responsibility of the publisher, and we do not independently review or endorse it.
10. Limitation of Liability
To the maximum extent permitted by applicable law, our aggregate liability to you in respect of the Service, whether based on contract, tort or any other legal theory, is capped at the total fees (if any) you have paid for using the Service; where the Service is provided free of charge, our liability is capped at RMB 100.
11. Amendments to These Terms
We may amend these Terms from time to time in response to changes in laws and regulations or business development. The amended Terms will be published via in-app notification or website announcement and will state the effective date. If you continue to use the Service after the amended Terms take effect, you are deemed to have accepted them; if you disagree with the amendments, please stop using the Service.
12. Governing Law and Dispute Resolution
The conclusion, validity, interpretation, performance and dispute resolution of these Terms are governed by the laws of the mainland of the People's Republic of China (excluding conflict-of-laws rules).
Any dispute arising from these Terms or the Service shall first be resolved through friendly negotiation; if negotiation fails, either party may bring a lawsuit before the people's court with jurisdiction at the principal place of business of our operating entity.
